This Data Processing Agreement forms part of the Terms of Service and applies where biz koncept LLC processes Personal Data on behalf of Users in the course of providing the Automarketar platform. This Agreement is intended to meet the requirements of Article 28 of the EU General Data Protection Regulation (GDPR) and other applicable data protection laws.
For the purposes of this Agreement:
The Company processes Personal Data only as necessary to provide the Platform and related services, including: Hosting and storing data, CRM and contact management, Email, SMS, WhatsApp, and messaging delivery, Automation, workflows, and AI-assisted features, Booking, scheduling, and analytics, Customer support and technical maintenance. Processing is limited to the duration of the User’s use of the Platform unless otherwise required by law.
Data Subjects may include: End customers of the User, Leads and prospects, Subscribers, Employees, contractors, or partners.
Personal Data may include: Names, email addresses, phone numbers, Communication content and metadata, Booking and scheduling information, CRM records and notes, IP addresses and device identifiers, Any other data uploaded by the User.
The Company shall:
The Company implements measures including: Encrypted data transmission, Access controls and authentication, Segregation of data, Monitoring and logging, Secure infrastructure and backups. Security measures are designed to protect against unauthorized access, loss, or disclosure.
The Company may engage subprocessors to provide services such as hosting, payments, messaging, analytics, or infrastructure. All subprocessors are: Carefully selected, Bound by contractual data protection obligations, Required to provide an equivalent level of protection. A current list of subprocessors may be made available upon request.
Personal Data may be transferred outside the EU, including to the United States. Where required, transfers are protected by: Standard Contractual Clauses, Other lawful transfer mechanisms.
The Company shall assist the User in responding to requests for: Access, Rectification, Erasure, Restriction, Data portability, Objection. Requests must be submitted by the User or data subject via the User.
In the event of a Personal Data breach, the Company shall: Notify the User without undue delay, Provide information necessary to meet legal obligations, Cooperate in remediation efforts.
Upon termination of services, the Company shall: Delete or return Personal Data upon User request, Retain data only where legally required. Backups may be retained for limited periods for security and compliance purposes.
The Company shall make available information necessary to demonstrate compliance with this Agreement and applicable law. Audits may be conducted subject to reasonable notice and confidentiality obligations.
Liability under this Agreement is subject to the limitations set forth in the Terms of Service. The Company is not responsible for the User’s failure to comply with data protection obligations as a Controller.
This Agreement is governed by the laws of the State of Wyoming, United States, without prejudice to mandatory EU data protection laws.
